Woodstock, Illinois -- A judge
has ordered a 16 year girl charged with hate crimes after posting fliers
containing a picture of a male student and homophobic statements in an area high
school to be held in custody at a juvenile detention center until her trial.
A second girl charged in the same incident has had her 24-hour curfew cancelled
and has been placed in home detention, allowed to leave only for court approved
purposes and required to wear an ankle bracelet monitoring device.
The fliers were found scattered around the parking lot of Crystal Lake South
High School.
The names of both teens are being withheld because they are minors.
The pair are charged with committing a hate crime, disorderly conduct, and
obstructing justice. The state's hate crime law includes sexuality or
perceived sexuality.
In ordering the first girl held in custody Judge Michael Chmiel told the
teenager's mother that he is very nervous about your daughter being home without
supervision," noting that the girl has had about a dozen other run-ins with
police over recent years, the Northwest Herald reported.
Her trial has been set for May 29.
An attorney for the second girl will be in court June 26 arguing to have the
case against his client dismissed.
"I feel the state hasn’t pleaded the necessary elements for a hate crime and
disorderly conduct," Charles McKenney told the paper.
Students at the school told the Northwest Herald that the fliers were produced
to get revenge on a friend after their relationship soured.
