Gay Rhode Island couple files for divorce

PROVIDENCE, R.I. Nov.22 -- Rhode Island law has remained silent on gay marriage -- which makes it hard for a judge to decide how to handle a gay divorce.

A lesbian couple has filed for divorce in Providence, citing irreconcilable differences.

They were married in Massachusetts, the only state to allow same-sex unions.

The judge has yet to decide if his court has jurisdiction to rule on the divorce.  Rhode Island hasn't made any decisions on whether to recognize gay marriages performed in Massachusetts.  And the state attorney general says that decision is up to the courts and legislature.

The judge says he thinks this is the first time a gay couple has filed for divorce in Rhode Island.
