TRENTON -- A Republican lawmaker says he's drafting legislation to outlaw same-sex marriage.

On Wednesday the state Supreme Court of New Jersey heard arguments in a case where the right for gay couples to marry is being decided.

Republican State Senator Gerald Cardinale is drafting a constitutional amendment banning gay marriage.  He hopes to introduce the legislation by February 27th.

Cardinale says the amendment is necessary because the court has a tendency to legislate from the bench.

Senator Cardinale believes marriage should be between a man and a woman.
