Gay Palimony Complaint Filed

The law firm of Diamond & Diamond, P.A., Millburn, New Jersey, filed a Complaint for Palimony and other legal and equitable relief on behalf of Robert Sumski, on or about January 6, 2004 in Ocean County Superior Court, Family Part.  The caption of the matter is Sumski v. Thomson, Docket No. FM-15-866-04C.

This litigation involves a homosexual relationship spanning more than 27 years, which relationship was akin to a marriage.  Mr. Sumski is seeking to be treated by the Court in the same manner as a heterosexual individual would be treated as a result of the dissolution of a 27 year cohabitation relationship or marriage. 

There is currently an application pending before the Court, returnable on Friday, February 13, 2004, at 9:00 a.m., before the Honorable Sheldon R. Franklin, J.S.C., for temporary support and restraints.  This application is identical to one which would be brought by a dependent spouse in a divorce setting.
