Attempt To Block Lesbian Judge Fails

Baltimore, MD -- The Maryland Senate has confirmed the nomination of Baltimore City District Judge Halee F. Weinstein.

A Republican move to disqualify her failed after Gov. Robert L. Ehrlich Jr. said he supported her nomination.  Weinstein had originally been nominated by Ehrlich's predecessor, Parris N. Glendening.

Sen. Alex X. Mooney, had attempted to block Weinstein's appointment.  Mooney alleged her honesty was suspect and offered as proof her military record of nearly two decades ago.

Mooney distributed blank forms to senators that he said were in use in the 1980s, which required an answer for sexual orientation. Gays and Lesbians are not permitted to serve in the military, but the forms were discarded following the introduction of 'Don't Ask Don't Tell'.  

Mooney suggested that Weinstein lied about her sexual orientation on the in order to join the military.

"Clearly the nominee falsified [information] in order to gain entrance to the military," Mooney said.  He argued that a person with a record of "dishonesty" is not qualified to sit on the bench.

The Republican Senator wanted her judicial nomination returned to committee for an investigation.

Weinstein has refused to comment on the allegation. Her nomination was approved by a 38-4 vote, with five abstentions
